Landlord-Tenant Disputes

Disputes may arise between a landlord and tenant either: 1) pre-tenancy, 2) during the tenancy, or 3) post-tenancy.

Pre-tenancy disputes

Disputes arising before a tenancy agreement is created may include:

Disputes arising during the tenancy

Disputes that may arise during a tenancy include:

  • Poor conditions of unit – breaching the warranty of habitability
  • Rent increases
  • Use of premises
  • Rights to assign or sublease
  • Unlawful discrimination
  • Repair and deduct
  • Tenant injury by defects on premises
  • Threatened eviction*

*If you are being threatened with an eviction, it is important that you act quickly and contact us today. If you have already been served with an unlawful detainer summons and complaint, a response is ordinarily due within 5 days. If you miss this deadline, you may face a default and immediate eviction.

Post-tenancy disputes

Disputes that may arise after a tenancy is terminated include:

  • Unlawful detainer
  • Tenant bankruptcy
  • Security deposit disputes
